Terms of Service
Rules for using Vidquel, including subscriptions, credits, and AI-generated content.
1. Agreement to terms
These Terms of Service ("Terms") govern access to and use of the Vidquel platform and related services (the "Service") operated by AI Video Generator Labs Inc. ("we", "us").
By creating an account, clicking "Allow actions" in AI Mentor, starting a generation, export, campaign, or checkout, you agree to these Terms and our Privacy Policy. If you use the Service on behalf of an organization, you represent that you have authority to bind that organization.
2. Eligibility
You must be at least 16 years old (or the minimum age in your jurisdiction) and able to form a binding contract. You may not use the Service if you are barred under applicable law or if we have suspended your account.
3. Accounts & security
- Authentication is provided through Better Auth on our own infrastructure; you must keep credentials confidential.
- You are responsible for activity under your account, including actions taken by AI Mentor when Allow actions is enabled.
- You must provide accurate account information and keep it updated via your account settings.
- Notify us promptly at support@example.com if you suspect unauthorized access.
4. The Service
The Service lets you create AI-assisted video projects using template-specific pipelines (including cinematic storytelling, Minecraft-style commentary, social chat layouts, and freestyle/stock montage), edit scenes in the dashboard editor, run batch campaigns, export MP4s, optionally publish to connected social accounts, and interact with AI Mentor.
Features depend on your plan, available credits, environment configuration (API keys), and template. We may modify, suspend, or discontinue features with reasonable notice where practicable.
5. Plans, credits & billing
5.1 Plans (as implemented in code)
Plan limits are defined in our internal plan catalog and enforced server-side:
- Free — 50 monthly credits, up to 3 active projects (DRAFT/GENERATING/SCRIPT_READY/RENDERING), exports may include a watermark
- Pro — 2,000 monthly credits, up to 50 active projects, no watermark, priority queue flag
- Business — 10,000 monthly credits, up to 500 active projects, no watermark, priority queue flag
5.2 Credit consumption
Credits are debited for pipeline operations according to configured costs (e.g. video pipeline start, per-scene TTS/stock, final render). Insufficient credits block chargeable operations. Free-tier monthly pools may refresh on a calendar basis as implemented in our credit ledger.
5.3 Subscriptions & checkout
Paid subscriptions are initiated via Polar checkout (POST /api/payments/checkout). Polar webhooks update subscription status in our database. Prices displayed on marketing pages are subject to change; checkout prices prevail at purchase.
Subscriptions renew automatically until canceled through the billing portal or provider flows Polar makes available. If payment fails, status may become PAST_DUE; access may be limited after any configured grace period (BILLING_PAST_DUE_GRACE_DAYS).
5.4 Refunds

If you believe you were charged in error, contact support@example.com within 14 days with your account email and checkout reference. We may offer prorated credits or refunds at our sole discretion. Chargebacks without contacting us may result in account suspension.
6. Acceptable use
You agree not to:
- Violate law or third-party rights (copyright, trademark, privacy, publicity, defamation)
- Generate or distribute illegal, exploitative, hateful, harassing, or deceptive content
- Attempt to bypass credits, plan limits, authentication, or template restrictions
- Probe or disrupt the Service (including unauthorized access to admin or queue endpoints)
- Reverse engineer the Service except where permitted by law
- Use the Service to build a competing model training dataset without our written consent
- Misrepresent AI-generated content as solely human-made where disclosure is legally required
7. Your content & license to us
You retain ownership of prompts, scripts, uploads, and other materials you provide ("User Content"). You grant us a worldwide, non-exclusive license to host, process, transmit, display, and transform User Content solely to operate the Service (including sending excerpts to AI and media providers you enable by using features).
You represent that you have all rights necessary for User Content and that its use through the Service will not infringe third-party rights.
8. AI-generated output
Subject to these Terms, we assign to you our rights, if any, in final video outputs produced specifically for your account through the Service, to the extent permitted by law and third-party provider terms (stock media, fonts, and platform music beds may carry separate licenses).
AI outputs are probabilistic. Similar outputs may be produced for other users. We do not warrant uniqueness, accuracy, or fitness for a particular purpose. You are solely responsible for compliance, disclosures (#ad, #AI), and rights clearance before distribution.
Template-specific features (e.g. cinematic AI still regeneration vs freestyle Pexels fetch) are enforced by our editor capability registry; the Service will not perform actions your template does not support in the editor.
9. Third-party services
The Service integrates Polar, Cloudinary, AI providers, stock media APIs, analytics, error monitoring, and optional social networks. Your use of those services may be subject to their terms. We are not responsible for third-party outages or policy changes.
10. Our intellectual property
The Service, including software, templates, UI, branding, and documentation, is owned by us or licensors. Except for the limited rights expressly granted, no rights are transferred. "Vidquel", and related marks are our trademarks or those of our affiliates.
11. Suspension & termination
We may suspend or terminate access for breach of these Terms, risk to the Service, non-payment, or legal requirement. You may stop using the Service at any time and request account deletion through support or through account deletion controls.
Upon termination, your right to use the Service ends. Provisions that by nature should survive (payment obligations, disclaimers, liability limits, dispute resolution) survive.
12. Disclaimers
THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS, IMPLIED, OR STATUTORY, INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, NON-INFRINGEMENT, AND UNINTERRUPTED AVAILABILITY. WE DO NOT WARRANT THAT EXPORTS WILL BE ERROR-FREE, THAT QUEUES WILL PROCESS WITHIN A SPECIFIC TIME, OR THAT AI OUTPUTS WILL BE LEGALLY COMPLIANT.
13. Limitation of liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW, WE AND OUR AFFILIATES, OFFICERS, EMPLOYEES, AND SUPPLIERS WILL NOT BE LIABLE FOR INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR LOSS OF PROFITS, DATA, GOODWILL, OR BUSINESS, ARISING FROM THE SERVICE.
OUR TOTAL LIABILITY FOR ANY CLAIM ARISING OUT OF THESE TERMS OR THE SERVICE WILL NOT EXCEED THE GREATER OF (A) AMOUNTS YOU PAID US IN THE 12 MONTHS BEFORE THE CLAIM OR (B) USD $100.
Some jurisdictions do not allow certain limitations; in those cases our liability is limited to the fullest extent permitted by law.
14. Indemnification
You will defend, indemnify, and hold harmless us from claims arising out of your User Content, your use of the Service, violation of these Terms, or violation of third-party rights, except to the extent caused by our gross negligence or willful misconduct.
15. Governing law & disputes

Courts in that jurisdiction have exclusive venue, except that either party may seek injunctive relief for IP misuse in any competent court.
If you are a consumer in the EEA/UK, you may have mandatory local rights that cannot be waived by contract.
16. Changes
We may update these Terms. The "Last updated" date will change. Continued use after changes constitutes acceptance. If you disagree, stop using the Service and cancel subscriptions.
